Terms of Service

nanoGOAT Parent

These Terms of Service ("Terms") govern your use of the nanoGOAT Parentapplication and related Parent services (collectively, the "Service") provided by nanoGOAT LLC ("nanoGOAT," "we," "us," or "our"), a Colorado limited liability company.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. nanoGOAT AAC is a separate product with their own terms.

1. Description of Service

nanoGOAT Parent is a companion app for caregivers. It may include features such as:

Daily "hops," day logs, and progress you record
Optional photos and moment/keepsake content
Cloud sync of account-backed content across your devices
In-app settings (including alternate app icons where supported)
Related website flows (for example account deletion at nanogoat.io)

Features may change over time. Parent is not a medical device and is not a substitute for professional advice.

2. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a Parent account. The Service is intended for adult caregivers, not for children as primary users.

You are responsible for your account credentials and for activity under your account. Provide accurate information, keep credentials confidential, and notify us of unauthorized use. We may suspend or terminate accounts that violate these Terms or create risk for other users or the Service.

3. Your Content

You retain ownership of content you create in Parent (notes, photos, logs). You grant nanoGOAT a limited license to host, store, back up, and display that content solely to operate the Service for you.

You represent that you have the rights needed to upload content you submit (including photos of children in your care) and that your content does not violate law or third-party rights. Do not upload unlawful, abusive, or infringing material.

4. Acceptable Use

You agree not to:

Misuse the Service, attempt unauthorized access, or disrupt our systems
Reverse engineer the Service except where permitted by law
Use the Service for unlawful purposes or to harm others
Impersonate others or misrepresent your affiliation

5. Subscriptions and Purchases

Some Parent features may be free; others may require a paid subscription or in-app purchase processed by Apple, Google, or another store. Store billing, refunds, and cancellations are governed by the applicable store's rules. Taxes may apply.

6. Privacy

Our collection and use of personal information is described in theParent Privacy PolicyandParent COPPA Policy.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANOGOAT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANOGOAT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.

9. Termination

You may stop using the Service and delete your account at any time (including viananogoat.io/account/delete). We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive termination.

10. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules. Courts in Colorado will have exclusive jurisdiction, except where consumer protection laws give you non-waivable rights in your home jurisdiction.

11. Changes

We may update these Terms. Material changes will be reflected by an updated effective date on this page and, where appropriate, in-app notice. Continued use after the effective date constitutes acceptance of the revised Terms.
