Terms of Service

Welcome to nanoGOAT AAC. These Terms of Service ("Terms") govern your use of the nanoGOAT AAC application, website at nanogoat.io, and related services (collectively, the "Service") provided by nanoGOAT LLC ("nanoGOAT," "we," "us," or "our"), a Colorado limited liability company.

By creating an account or using the Service, you agree to be bound by these Terms. If you are a parent or guardian creating an account for a child, you agree to these Terms on behalf of yourself and your child. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

nanoGOAT AAC is an augmentative and alternative communication (AAC) application designed to help individuals, particularly children, communicate using customizable picture-based communication boards. The Service includes:

  • The nanoGOAT AAC mobile application (available on iOS, Android, and Amazon Fire)
  • Cloud sync and board sharing features
  • The nanogoat.io website and related web services

2. Eligibility and Accounts

2.1 Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. The Service is designed for use by children under the supervision and with the consent of a parent or legal guardian. Children under 13 may not create accounts themselves.

2.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials secure and not share them with others
  • Notify us immediately if you suspect unauthorized access to your account
  • Accept responsibility for all activities conducted through your account

2.3 Parental Responsibility

If you create an account for, or allow a child to use the Service, you assume full responsibility for that child's use of the Service. You represent that you are the child's parent or legal guardian and that you consent to the child's use of the Service in accordance with these Terms and our COPPA Compliance Policy.

3. Free and Paid Services

3.1 Free Core Features

We believe communication is a fundamental right. Core AAC communication features are and will remain free of charge, including:

  • Creating and using communication boards
  • Customizing buttons with text, colors, and images
  • Text-to-speech output
  • Multiple user profiles on a single device

3.2 Premium Features

We may offer optional premium features or services for a fee in the future. If we do, we will clearly identify which features are paid before you incur any charges. Premium features will never gate basic communication functionality.

4. User Content

4.1 Your Content

"User Content" means any content you create, upload, or share through the Service, including communication boards, custom images, button labels, and board configurations. You retain ownership of all User Content you create.

4.2 License Grant

By uploading or creating User Content through the Service, you grant nanoGOAT a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing the Service to you. This license ends when you delete your content or your account.

4.3 Shared Content

If you share board sets via QR codes or sharing links, you understand that anyone with access to that code or link can view and import your shared board content. You are responsible for what you choose to share and should not include sensitive personal information in shared boards.

4.4 Content Standards

You agree not to upload or share User Content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Contains sexually explicit material, especially involving minors
  • Infringes on the intellectual property rights of others
  • Contains malware, viruses, or other harmful code
  • Violates the privacy of others

We reserve the right to remove User Content that violates these standards and to suspend or terminate accounts that repeatedly violate them.

5. Acceptable Use

You agree to use the Service only for its intended purpose — augmentative and alternative communication — and in compliance with all applicable laws. You agree not to:

  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to transmit spam or unsolicited communications
  • Reverse-engineer, decompile, or disassemble the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate another person or entity
  • Use the Service in any way that could harm children or vulnerable individuals

6. Intellectual Property

6.1 Our Property

The Service, including its design, code, graphics, user interface, logos, and trademarks (including the nanoGOAT name, Gigi, and Benny mascot characters), is the property of nanoGOAT LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

6.2 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation. You are not obligated to provide feedback.

7. Medical Disclaimer

nanoGOAT AAC is a communication tool, not a medical device. The Service is not intended to diagnose, treat, cure, or prevent any medical condition or disability. It is not a substitute for professional speech-language pathology services, medical advice, or therapeutic intervention.

We encourage users to work with qualified speech-language pathologists and other professionals when developing communication strategies. The effectiveness of any AAC tool depends on individual circumstances, proper setup, and ongoing support from trained professionals and caregivers.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the Service will meet your specific requirements or expectations.

Because the Service may be used for communication by individuals with disabilities, we make every reasonable effort to ensure reliability. However, you should not rely on the Service as your sole means of communication in emergency situations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NANOGOAT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. Indemnification

You agree to indemnify, defend, and hold harmless nanoGOAT LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any User Content you create or share through the Service

11. Termination

11.1 By You

You may stop using the Service and delete your account at any time. Upon account deletion, your data will be handled in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in abusive behavior, or if we reasonably believe it is necessary to protect the Service or its users. We will make reasonable efforts to notify you before or at the time of termination, except where immediate action is required.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including sections on intellectual property, disclaimers, limitation of liability, and indemnification) will continue in effect.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing any formal proceeding, you agree to try to resolve any dispute informally by contacting us at [email protected]. We will try to resolve the dispute informally within 60 days.

12.3 Jurisdiction

If informal resolution is unsuccessful, any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Colorado. You consent to the personal jurisdiction of these courts.

If you are located outside the United States, you may have additional rights under your local consumer protection or data protection laws that cannot be waived by contract. Nothing in these Terms is intended to limit those statutory rights.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Effective Date" at the top of this page
  • Notify you via email or in-app notification at least 30 days before the changes take effect
  • Give you the opportunity to review the changes before they become binding

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service.

14. General Provisions

  • Entire Agreement — These Terms, together with our Privacy Policy and COPPA Compliance Policy, constitute the entire agreement between you and nanoGOAT regarding the Service.
  • Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver — Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
  • Assignment — You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • No Third-Party Beneficiaries — These Terms do not create any third-party beneficiary rights, except as expressly stated herein.
